The treaty is now available for ratification here. The State of Beiteynu extends its gratitude to the participants for taking part and assisting in reinvigorating the organisation. The discussion on the MSO/MSCO has concluded, thus we pass the torch to the leadership of the Zardic Federation for the 1st rotation.
We hereby open the discussion on the MEA/MA. The representative from Deltaria has the floor.
Thank you to our Beiteynese colleague. Deltaria, as the original founder of the MEA and later MA, would like to propose the reintroduction of the organization. The MA, together with the previous MSO, had been two organization that ended up ushering in unprecedented prosperity and unity on our continent, traditionally plagued with strive and conflict. Therefor, we propose a deep economic and political union that unites our countries under a single bloc but still retains the sovereignty of its member states. We propose the following.
Article 1 "Founding Principles"
-Member states shall eliminate any and all tarrifs and trade barriers between one another, with the exception of barriers that member states collectively decide to put in place.
-Member states shall guarentee visa free travel for citizens of other member states as well as eliminate physical border checks if the states in question share a border.
-Member states shall adopt a common external trade policy, directed and regulated by the MA its various institutions and bodies and approved by unanimity of member states.
-Member states shall agree to cooperate on the area of security as well as economics and regional politics and shall strive to ensure healthy dialogue between member states.
-Member states shall respect the rule of law, democracy and human rights.
-Member states shall contribute 0.2% of their GDP annually to a common Association Budget, which is managed by the executive committee and may only be used to finance MA wide economic projects and maintain MA institutions.
Article 2 "Institutions"
-A Executive Committee is established, chaired by the President of the Majatran Association and consisting of 5 other Majatran Commissioners, these being:
-The Commissioner for Majatran Affairs
-The Commissioner for Economic Affairs
-The Commissioner for Global Affairs
-The Commissioner for Security Affairs
-The Commissioner for Human Rights
-The President of the Majatran Association is elected every 10 years by a meeting of the Collective Assembly.
-Commissioners are appointed by the President of the Majatran Association upon his election.
-The Executive Committee handles day to day affairs of the MA, serves as its face within and outside the continent and is responsible for fascilitating negotiations and cooperation between member states.
-The Collective Assembly consists of all the heads of states or the foreign minister of member states and is the prime decisionmaking body of the MA.
-The Collective Assembly may proposes initiatives to be executed by the Executive Committee, may elect a MA President, may remove a Executive Committee and makes other important decisions within the MA.
-The Collective Assembly shall serve as a forum for member states to solve disputes and work together on keeping the peace within Majatra.
-Votes within the Collective Assembly must always be unanimous.
-The Majatran Court of Justice is the highest judicial court within each member state on the topics of human rights, environmental policy and trade policy with member states agreeing to divert final judicial judgement to the MCJ.
-The Majatran Court of Justice shall consists of judges from all member states, which shall be randomly selected every 5 years.
Deltaria hopes for the feedback of other states. As you can notice, we have removed the MTAP from this proposal, instead opting to give all power to member states through the Collective Assembly, with day to day governance diverted to the Executive Committee. We look forward to the opinions of others.
We have some concerns regarding certain founding principles and would like to state our position.
As a nation which places strong emphasis on border security, we are opposed to eliminating physical border checks. While we support visa-free travel between member states, we believe certain provisions to maintain national security are needed. Thus we propose this amendment to Article 1, Section 2:
"Member states shall allow visa-free travel for citizens holding valid passports for a period not exceeding 90 days. Either member state may temporarily suspend the application of this clause for reasons of national security and public order. Such suspension of the clause shall be notified immediately to the organisation through diplomatic channels."
The other point we want to make is concerning tariffs. We should allow member states to impose tariffs or quotas in order to protect their economical positions. If not, economical independence of individual countries would be in jeopardy.
Cildania's government is concerned about the proposal to create a Majatran Court of Justice. Although we understand that mechanisms for dispute resolution are required, we are not prepared to cede such wide-ranging powers to this new organisation. In particular, we object to the suggestion that the new institution would become the "highest judicial court within each member state". Cildania is not willing to compromise its self-government to this extent. Aside from that, we are optimistic about the document that has been presented.
We can understand the concerns of our colleagues. We could agree to a ammendment on the freedom of movement as proposed by the Jakanian representative. However, on the topic of tarrifs we should not budge, as a tarrif free zone is the foundational pillar of any organization of this kind, allowing equall competitition and less obstacles between member states as a whole. On the concerns of Cildania we are open to suggestions how to properly fit the Majatran Court of Justice into the MA framework without a infringement of sovereignty as big as currently proposed. Does the Cildanian representative have any suggestions?
In regards to visa free travel we find the Jakanian proposal to be suitable.
We share concerns about trade and tariffs, we feel that nations should be permitted to place tariffs in order to protect national and sovereign economic interests. We would generally agree that nations should work towards being tariff free and allowing the development and growth of economics between nations.
In regards to the Majatran Court of Justice we vehemently oppose any sort of supranational entity allowing themselves to be above national and sovereign law. We would agree to allowing the MCJ to settle disputes between member states when it comes to trade. We would also permit the MCJ to issue non-binding rulings related to matters in the original treaty.
