Name of the Law/Policy: Government policy concerning Rape
Law/Policy Category: Civil Liberties

Options:

1. The government has no policy concerning Rape
2. Rape is illegal and convicted rapists are prosecuted
3. Rape is illegal, but only the rape victims that are prosecuted
4. The government persecute both convicted rapist and the victim
5. Local government decide this

Effects:

1. Increase Small Government, and slight decrease in Civil Rights
2. Slight increase in Civil Rights (after all it's what normally applies)
3. Significant decrease in Civil Rights
4. Decrease in Civil Rights
5. Increase in Devolution

Note: In some Islamic countries, sometimes it's the rape victims that persecuted, and sorry for grammar mistakes

  3. Rape is illegal only when perpetrated by one gender.
  4. Local governments decide on the legality of rape.


There's no evidence that rape victims are prosecuted in Islamic countries, specifically because they are victims of rape so I think this is superfluous.

If I'm not mistaken, it's not that it's a crime to be a victim of rape, but rather that it's a crime to have extramarital sex, and unless the woman can prove that she was raped by presenting four independent witnesses (good luck with that!), it is assumed that she willingly took part in extramarital sex. And then there's the thing about showing your hair or part of your skin being considered an invitation to sex.

We already have options to ban fornication and adultery, so what we could do is add a law specifying how tough the requirement on evidence is on rape cases.

That said, I also think there should be a law about the definition of rape, and laws regulating the age of consent could be mixed into it.
