Right now there are five variables:

1. Adultery is illegal, but not prosecuted.
2. There is no explicit government policy on adultery.
3. Adultery is legal.
4. Adultery is a capital offence.
5. Local governments establish policies on adultery.

There is no room between "illegal, but not prosecuted" and the death penalty. It would make sense to add another option, that it is prosecuted (or perhaps to change the "capital offence" option to that, given that "capital offence" is not an option for other laws).

So you'd be interested in something such as "Adultery is against the law and is prosecuted."?
