The Government of the newly created Socialist Soviet Republic of Triguania believe this article to be an attack on Socialism and an attempt by this orginisation to take further control over Terra! We will fight this article every step of the way. Triguania votes no to resolution 38

OOC: Short on time, sorry for going out-of-character. Here's a summary of the Resolutions so far:


Resolution 38 establishing a World Congress Peacekeeping Force is currently 2-1, with Istalia and Malivia in favor and Trigunia against. Auditorii, back on page 8 in the speech where you proposed the original draft of R38, you said at the end of your speech that you were voting Yes on 37. Was that a typo? Did you mean to vote for 38 instead?


Resolution 37 urging a ceasfire in the Hulstro-Kazulian War is currently 0-0 or 1-0 depending on whether Auditorii meant to vote for R37 or R38. Corvo, you still need to vote on 37 if you want the Voting Period to begin.


Resolution 36 establishing a Security Council Task Force has been withdrawn by Malivia and is no longer on the table for vote or debate.


Resolution 35 imposing an embargo on Kalopia is currently 3-0. I'm declaring this Resolution passed. I know we haven't reached the end of the 1-Week Voting Period yet and that Baltusia and Trigunia haven't voted on R35. However, because Security Council members have already built an international coalition to enforce sanctions, the RP is too far developed now to reverse course. So the Yes votes by Malivia, Istalia, and Dorvik are locked-in and can't be changed. Baltusia and Trigunia, unfortunately if you want to make changes to Resolution 35 now, your only option is to propose a Resolution that contradicts or repeals R35.


Resolution 34 cutting diplomatic ties with Kalopia and Narikaton is currently 3-0. Voting will continue until next Friday or until Trigunia and Baltusia vote, whichever is sooner.


Resolution 33 condemning Beiteynu is currently 0-1. The 1 vote against was cast by Rildanor which is no longer a member of SC. Since Baltusia replaced Rildanor in Seat C, Baltusia may change that vote if they wish. Axxell, you never voted on Resolution 33, so the official Voting Period hasn't started yet.


Resolution 32 banning foreign military aid for belligerents in the Badaran Conflict has been withdrawn by Istalia and is no longer on the table for vote or debate.


Resolution 31 authorizing the removal of Security Council members has been temporarily postponed by the Secretariat pending a decision by the moderator Jamescfm when he returns from vacation.


Resolution 30 requiring General Assembly pre-approval of Security Council Resolutions failed by a vote of 2-0 when Istalia withdrew its Yes vote. R30 was also postponed by the Secretariat pending a decision by the moderator Jamescfm when he returns from vacation.


Resolution 29 authorizing expulsion of General Assembly and Security Council members, which was passed but tabled for contravention of the World Congress Charter by the Secretariat, may be reentered for consideration depending on the decision by the moderator Jamescfm when he returns from vacation.


Resolution 28 condemning terrorism is currently tied 2-2. There was some confusion about this Resolution because it was proposed in the previous SC session then amended twice during this session. Also, 1 Yes vote and 1 No vote were cast by countries that are no longer members of the SC. Their replacements, Baltusia and Trigunia, may change their predecessors' votes if they wish, and Istalia and Dorvik may also change their votes which are still being counted despite amendments to R28 having been made after Istalia and Dorvik voted. Because R28 was originally submitted before the 1-Week Voting Period policy was announced, this Resolution will remain at vote until there are 3 votes in favor or against, or until the end of the session, whichever is sooner. So Corvo, Malivia can still vote on R28 if you want.

Istalia is close to next elections. So, for the moment, the outgoing administration want announce that we vote AYE to the Resolution 37 and that the Resolution 33 will be droped out by Istalia.
We prefer to present a new Resolution, a Resolution to promote and protect these rights of citizens and duties of the Governements which make a nation a Democracy, a Resolution which will condamn first of all segregation policies and slavery as practice which not only undermine the dignity of the human beings (which already as crime against humanity were already condamned by this organization), but also which limit any possibility of freedom of expression and speech as well as any political rights to part of the people of a nation which cannot be definite as a Democracy.
For too long time too many nations asked for "responsability" of the Security Council but without offer nothing! This executive body as well as any other executive body elected or chosen in anyway by a people have to be responsable for their actions, this, sure, will avoid also the arrival to the power in this or that nation of exalthated people or horridous ideologies which can treat the peace aven more easily than a democracy, the example since the foundation of this organization are numerous.
Let's analyze the crisis this organization was called to face in these century and we can perfectly realize that undemocratic nations was at the center of all these crisis! It is not ideology, it is the evidence of the facts!

Istalian Government would like present this ambitious chart to contribute to put an end to the bending of the international laws to the interests of this or that nation.

This is our proposal (any proposal to modify this text will be welcomed to be discussed):

International Chart of the Human Rights

Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people,

Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law,

Whereas it is essential to promote the development of friendly relations between nations,

Whereas the peoples of Terra have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,

Whereas the Nations of Terra have pledged themselves to achieve, in co-operation with the rest of the World, the promotion of universal respect for and observance of human rights and fundamental freedoms,

Whereas a COMMON UNDERSTANDING of these rights and freedoms is of the greatest importance for the full realization of this pledge,

THE INTERNATIONAL CHART OF HUMAN RIGHTS should be a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of the Nations of Terra themselves and among the peoples of territories under their jurisdiction.

Article 1.
All human beings are born free and equal in dignity and rights.They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.

Article 2.
Everyone is entitled to all the rights and freedoms set forth in this Chart, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty.

Article 3.
Everyone has the right to life, liberty and security of person.

Article 4.
No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

Article 5.
No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Article 6.
Everyone has the right to recognition everywhere as a person before the law.

Article 7.
All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.

Article 8.
Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.

Article 9.
No one shall be subjected to arbitrary arrest, detention or exile.

Article 10.
Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him.

Article 11.
(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
(2) No one shall be held guilty of any penal offence on account of any act or omission which did not constitute a penal offence, under national or international law, at the time when it was committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the penal offence was committed.

Article 12.
No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Article 13.

(1) Everyone has the right to freedom of movement and residence within the borders of each state.
(2) Everyone has the right to leave any country, including his own, and to return to his country.

Article 14.

(1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
(2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of this Chart.

Article 15.

(1) Everyone has the right to a nationality.
(2) No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

Article 16.
(1) All the human beings of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution.
(2) Marriage shall be entered into only with the free and full consent of the intending spouses.
(3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.

Article 17.
(1) Every natural or legal person, alone as well as in association with others, is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except upon payment of just compensation, for reasons of public utility or social interest, and in the cases and according to the forms established by law and by the general principles of international law.
(2) The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties

Article 18.
Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.

Article 19.
Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.

Article 20.
(1) Everyone has the right to freedom of peaceful assembly and association.
(2) No one may be compelled to belong to an association.

Article 21.
(1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.
(2) Everyone has the right of equal access to public service in his country.
(3) The will of the people shall be the basis of the authority of government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote OR BY EQUIVALENT FREE VOTING PROCEDURES.

Article 22.
Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.

Article 23.
(1) Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.
(4) Everyone has the right to form and to join trade unions for the protection of his interests.

Article 24.
Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.

Article 25.
(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

Article 26.
(1) Everyone has the right to education. Education shall be free, at least in the elementary and fundamental stages. Elementary education shall be compulsory. Technical and professional education shall be made generally available and higher education shall be equally accessible to all on the basis of merit.
(2) Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedoms. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of the nations of Terra for the maintenance of peace.
(3) Parents have a prior right to choose the kind of education that shall be given to their children.

Article 27.
(1) Everyone has the right freely to participate in the cultural life of the community, to enjoy the arts and to share in scientific advancement and its benefits.
(2) Everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author.

Article 28.
Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

Article 29.
(1) Everyone has duties to the community in which alone the free and full development of his personality is possible.
(2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.
(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of this Chart.

Article 30.
Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein.

Article31.
The present Declaration shall remain deposited in the archives of the World Congress. Duly certified copies thereof shall be transmitted by the World Congress to the Governments of the nations of Terra.

Collegues,
My Government established a contact with the new Government of Western Kalopia.
They are claiming to are working to democraticize the nation. So, also because we are not insensible to the difficult of the common citizens due the embargo, we proposed to Western Kalopia to welcome an evaluation mission of the World Congress to check the nation and determine if there are the conditions described, so the reintroduction of a democratic system, the end of the human rights violations. They agreed. But we think we should also verify the end of all operations sponsorized by the Thallers in third nations, like terroristic attack, as accused by Jakania. For this reason we would also demand to the new govenrment to withdraw from its WMD program.

But we remain dubtfull of the position of Malgus III. He ordered several infringment of the human rights. What should we understand by the position maintained by Malgus III in the new Kalopia?
What is the opinion of the other members of the SC?

Okay, since we're getting close to the end of the session, I'm gonna wrap up some of the Resolutions early.

R28 condemning terrorism is passed.

R33 condemning Beiteynu is withdrawn by Istalia and is no longer on the table for vote or debate.

R37 urging a ceasfire in the Hulstro-Kazulian War is passed.

R38 establishing a World Congress Peacekeeping Force is passed.

A few important points about this one (R38):

  • I'm closing the vote early to give you guys time to start setting up the Peacekeeping Office. Trigunia, I know you're against the Resolution, but you've had the weekend to lobby support against it and I didn't notice much of that happening. It also seems like Baltusia won't be sending a delegation to SC this session. Because of the unique nature of R38, it's gonna take alot of time and effort by SC members to get it setup. Rather than hold up any such efforts on the possibility that the delegations with high absences will chime in, we're gonna shift things in favor of the high-attendance delegations instead this time. Baltusia and Trigunia, if you want to oppose R38 from this point forward, your only remaining options are to propose a resolution amending or repealing R38.

  • R38 suffers from several of the same problems found in R30 and R31. The biggest problems in R38 are that it's unclear about whether it's giving the General Assembly powers of oversight and veto over Peacekeeping Force operations; it's inconsistent in distinguishing between non-state General Assembly members and state members, leading to several provisions that seem to suggest non-state GA participants may also be required to make troop and funding contributions to the Peacekeeping Office in addition to state GA participants; and finally it's unclear as to whether the penalty for Member States who commit grave violations against R38 could include suspension and expulsion from the World Congress.

    Some of these issues have already been noticed and remarked on by members of the General Assembly, and controversy in the General Assembly and governments around Terra regarding these issues is likely to increase as the Peacekeeping Force is stood-up and deployed. However, since R38 mostly focuses on In-Character matters and only incidentally pushes the line on Out-of-Character Game Rules issues, I'm considering this Resolution legitimately drafted and passed as-is. BUT if or when fall-out in the GA and governments occurs regarding the drafting issues in this Resolution, SC members must be prepared to confront and resolve such controversies themselves. I as Gen Sec will throw the ball in your court if or when complaints about the legality and any contradictions in R38 are raised.

  • Finally, when you all are ready to nominate characters for Director-General and/or Inspector-General, please do so using a normal Resolution structure. In other words, just write a resolution noting the name and any relevant information about the character you're nominating for DG or IG. If any nominations and 3 votes in favor come in before the end of the session, I'll pass those votes early so the Peacekeeping Office can be in place by the start of the next session if possible.
